It is not uncommon for a defendant to also want to be exempted from potential future claims. A broad and clearly formulated discharge clause may be a defence against a subsequent claim, even if neither party is aware of the potential subsequent claim at the time of the settlement agreement: Khanty-Mansiysk Recoveries Ltd v Forsters LLP [2018] EWCA Civ 89. A settlement agreement that affects a minor child`s claim for injury may require court approval pursuant to Florida law ยง 744.387. If the bill is less than $15,000, the parent/guardian can settle the minor child`s claim. If a lawsuit has been filed and the case is less than $15,000, the judge may still require that an application for approval of the settlement be filed, and the judge will generally approve the settlement and the funds will be paid to the parent/guardian. In cases where the minor child`s claim exceeds $15,000, court approval is required.

An application for approval of the by-law must be submitted.
